The national minimum wage and the NES are the minimum rights for workers in Australia. A worker can keep an employer on an employment contract that has more favourable conditions, for example higher wages. B annual leave, etc. The Fair Work Act 2009 provides a simple, flexible and fair framework that helps employers and workers negotiate in good faith to enter into an enterprise agreement. If the parties fail to agree on the terms of a proposed enterprise agreement, a representative of the negotiations may ask the Commission for assistance in fair work. If, after six months of negotiations, the employers` and trade union organizations fail to agree on the terms of a Greenfields agreement, the employer can continue to submit the agreement to the Fair Work Commission. A registered agreement sets out the conditions of employment between a worker or a group of workers and one or more employers. All workers covered by the outstanding agreement are entitled to vote on the agreement. If the majority of staff who voted valid approve the agreement, the Enterprise Agreement will be submitted to the FWC for approval.
